Seller Terms & Conditions

These Seller Terms & Conditions ("Seller Terms") apply to all users who create listings or sell items on The Motorsport Hangar ("we", "us", "our").

By creating an account or posting any listing on our platform, you agree to follow these Seller Terms in full, as well as our general Terms of Service and Acceptable Use Policy.

1. Our Role

The Motorsport Hangar provides a classifieds platform only. We do not:

• act as a broker, dealer, or agent
• verify item authenticity or condition
• mediate or guarantee payments
• inspect, store, or handle listed items
• participate in transactions between buyers and sellers

You acknowledge that all communication, negotiation, payment, inspection, and delivery occur directly between you and the buyer.

2. Seller Eligibility

To sell on our platform, you must:

• be 18 years or older
• have legal ownership of the item you list
• provide accurate personal and business information
• comply with UK laws and regulations
• not be suspended or banned from the platform

We may request ID verification at any time.

3. Accuracy of Listings

As a seller, you agree that:

• All listing information must be truthful, accurate, and not misleading
• Photos and videos must represent the actual item for sale
• You must own the rights to the photos, videos, and descriptions used
• You must disclose any known defects, damage, or faults
• Prices must be stated clearly and honestly
• You must not create duplicate or spam listings

We reserve the right to edit or remove any listing that we believe violates these Seller Terms.

4. Prohibited Items

Sellers MUST NOT list:

• stolen goods
• counterfeit parts or apparel
• fake or cloned ECUs
• unsafe items (e.g., damaged safety equipment)
• items containing personal data (e.g., used radios with stored frequencies)
• illegal or restricted items
• weapons
• items unrelated to motorsport
• fraudulent listings
• misleading "bait and switch" adverts

If we believe an item breaches these rules, we may remove your listing or suspend your account immediately.

5. Listing Fees, Subscriptions & Upgrades

5.1 Listing Fees

Listing fees apply based on item value category. These fees must be paid in full before the listing goes live.

5.2 Subscription Plans

Subscription benefits apply only to listings under £5,000. High-value listings must be purchased individually using our standard listing packages.

You agree not to misuse subscriptions to avoid higher listing fees.

5.3 Refunds

Listing fees, upgrade fees, and subscription payments are non-refundable once the listing is live. Subscription renewals are billed automatically unless cancelled before the renewal date.

6. Seller Responsibilities

Sellers must:

• respond to buyer enquiries within a reasonable time
• act professionally and courteously
• ensure items are accurately described
• comply with all applicable legal requirements
• remove listings once sold
• update listings if availability changes
• ensure that motorsport vehicles are sold legally (e.g., proof of ownership, V5C if applicable)

7. Vehicle & Equipment Sales: Extra Requirements

For items such as race cars, engines, gearboxes, and safety equipment, you must:

• accurately represent mileage/hours
• disclose rebuild history if known
• state whether the item is race-used
• state whether the item is sold "as is"
• not hide known damage or faults
• comply with safety and trading standards

Buyers rely on your description. Misrepresentation may result in removal or legal action.

8. Communication With Buyers

Communication must occur through:

• our internal messaging system
• seller-provided contact information (if shared voluntarily)

You must NOT:

• harass, abuse, or threaten buyers
• pressure buyers into off-platform payments for fraudulent reasons
• send spam or unrelated promotions
• request unnecessary personal data

We may monitor messages to protect users and the platform.

9. Payments Between Buyer & Seller

The Motorsport Hangar DOES NOT:

• process payments for item purchases
• handle deposits or escrow
• guarantee payment
• resolve payment disputes

Sellers are responsible for agreeing:

• price
• deposit terms
• collection/delivery
• payment method
• inspection arrangements

We recommend secure, traceable payment methods.

10. Fraud Prevention

You must NOT:

• list items you do not own
• use stolen images/videos
• misrepresent ownership
• create false demand or fake enquiries
• attempt to deceive buyers
• create multiple accounts for manipulation
• request deposits for items you cannot supply

Fraud will result in account termination and possible legal action.

11. Intellectual Property

By creating a listing, you grant us permission to:

• display your photos, videos, and descriptions
• use your listing in marketing materials
• show your listing in email newsletters
• promote your listing on social media

You retain full ownership of your content.

12. Limitation of Liability

To the maximum extent permitted by law:

We are not liable for:

• losses arising from transactions
• disputes with buyers
• inaccuracies or misrepresentations in listings
• lost profits, reputation, or data
• fraudulent behaviour by users
• issues relating to vehicle safety, legality, or condition
• delivery or collection problems

You use the platform entirely at your own risk.

13. Account Suspension & Removal of Listings

We may suspend or remove any listing or account that:

• violates these Seller Terms
• is fraudulent or misleading
• breaches our Prohibited Items list
• harms buyer trust or safety
• receives multiple complaints
• involves suspicious behaviour

Decisions are final and may be made without notice.

14. Legal Compliance

Sellers must ensure compliance with:

• UK consumer law (where applicable)
• Trading Standards
• Vehicle sales regulations
• Motorsport safety equipment rules
• Intellectual property laws
• Tax obligations

You are responsible for declaring any income earned through sales.

15. Changes to These Seller Terms

We may update these Seller Terms at any time. Continued use of the platform means you accept the updated version.

16. Governing Law

These Seller Terms are governed by the laws of England and Wales. Any disputes must be resolved in the UK courts.
